SMSH Partner Matt Shaffer has filed suit in two new Jones Act claims in Texas.
In the first Texas case, Mr. Shaffer represents an injured deckhand. Injuries were sustained while working on a push boat/river boat after signing on in the Port of Houston. The plaintiff was facing up another boat, struggling to pull face wire, when he felt a snap and immediate pain. He did not have the help required to perform this work safely. This plaintiff suffered a back injury and pain in other body parts.
In the second Texas case, a QMED-Pumpman seaman was injured aboard a tanker after signing on in the Persian Gulf. While washing down the pump room to clear off the large volume of cement dust, Plaintiff slipped on the very slippery deck and fell down a flight of stairs. The deck and stairs did not have the required non-skid applied, no diamond plating, and there was no chain to protect seamen from falling down the stairs. This plaintiff suffered injuries to his head, neck, collar bone, back and hips.
