Two people were killed and 12 injured when a school bus failed to yield at a railroad crossing and collided with a freight train Monday in North Dakota.
The bus was traveling on a country road when it was struck on the passenger side near the doors by an empty BNSF freight train. The bus driver and a 17-year-old student were killed in the accident. The bus was carrying students from ages 5 to 17. Of the injured, three were in critical condition.
According to Highway Patrol Lt. Troy Hischer, the rural railroad crossing had no crossing arms, but the train still has right of way. The weather was clear when the accident occurred.
The BNSF train had two crewmembers aboard, but neither was injured in the collision.
Driver error is a common cause of school bus accidents. When your child is injured in this type of collision, it’s important to explore your legal options as soon as possible. Bus accident victims may be entitled to compensation for medical bills and other damages.
