It was a typical afternoon when Carlita and her 2-year-old daughter were shopping for cellphones at a local Metro PCS store. The 2-year-old reached for a cell phone that had a cord attached to the display. The display then toppled onto her. Attorney Jonathan S. Harris obtained a $1.1 million dollar settlement against the Metro PCS franchise for not properly securing the display to the wall. The Metro PCS store denied it was responsible, claiming it had no notice of the problem. Metro PCS also blamed the child’s mother for not watching her closely enough while in the store. After taking the case, Jonathan S. Harris filed suit immediately and requested a protective order to secure the display and any fittings used to secure the display to the wall. An inspection revealed the Metro PCS store did nothing to secure the display to the wall, even though the display was top-heavy and had a tendency to tip over. The lawsuit also uncovered documents from the manufacturer that contained instructions and hardware to bolt the display to the wall.
