On Monday, July 29th, the Coast Guard had to make the difficult decision to halt its search for a 15-year-old boy who disappeared while surfing with friends off Huntington Beach, California. The search began around 9 p.m. on Sunday after reports that the teen was missing near lifeguard tower 11.
Crews put in almost a full day’s work, taking nearly 20 hours and covering a 105-square-mile search area. With heavy hearts, they suspended the search by the time Monday evening rolled around.
Waves around the area where the teen went missing were reaching three to five feet high, accompanied by some seriously strong rip current, which are narrow channels of fast-moving water that pull whatever is near them out from the shore through the surf line.
According to the US Coast Guard, swimmers caught in a rip current should conserve energy by trying not to panic or fight the currents. Instead, swim parallel to the shore until the grip of the current relaxes and travel back to land at an angle away from it. Always aim for beaches with lifeguards and heed their advice since they know their zones better than anyone else.
The question of liability in situations like a swimmer going missing depends on the specifics.
Say there was supposed to be a lifeguard on duty keeping an eye out or warning folks about potential hazards like rip currents, but they were not around at the time of an emergency. That factor could shift responsibility onto the parties who were supposed to ensure proper supervision. On the other hand, if all precautions were taken and signs posted, it may be harder to pin down liability.
Maritime laws could come into play during incidents like these. These laws help determine responsibility—such as ensuring local beach authorities complied with safety measures. Some cases can have shared fault where both the victim and defendants (like local governing bodies or private property hosts) might share responsibility based on established safety guidelines and warnings—or a lack thereof.
For victims of maritime accidents or their families facing the aftermath, reaching out to legal professionals with a strong track record, like Schechter, Shaffer & Harris, is highly recommended. They bring a deep understanding in navigating the complexities of maritime laws to help secure the just outcome you deserve.
