What Is a Personal Injury Claim?

Unfortunately, injuries are a part of life. We are bound to get them from time to time and hopefully, when they happen, they will be minor. Sometimes though, accidents happen that we cannot prevent because they are caused by negligence on someone else's part. In this case the victim may choose to file a personal injury claim for his injuries. So what is a personal injury claim, exactly?  If someone either knowingly or unknowingly causes you harm you have the legal right to seek compensation.

There are a wide range of situations where someone may be injured as a result of another person's negligence. As car accidents, work accidents, slip and fall injuries, assaults, accidents in the home and injuries from defective products are some of the most common. Medical and dental errors can also be classified as personal injury cases. In addition, people who have acquired diseases associated with industrial hazards including asbestosis and mesothelioma can make a personal injury claim. Even undue stress caused by a workplace situation can potentially be the basis for a personal injury claim if another party is found to be at fault for the circumstance.

Compensatory damages are the most commonly sought and granted forms of compensation in personal injury cases. Intended to reimburse the plaintiff for costs incurred as a result of the accident, compensatory damages can cover such expenditures as medical bills, lost wages when the victim was unable to work, repairs and many others. They can sometimes include a fee for pain and suffering resulting from the accident. If the incident caused the victim grief, embarrassment or pain, these additional damages may be sought.

If a defendant is found to have been intentionally negligent, punitive damages may be awarded. Punitive damages are granted above and beyond the basic compensation. They are meant to penalize the negligent party for knowingly being remiss or intentionally causing harm. In addition, they serve to set an example to others of what can happen should they make the same choice. The defendant must be found to have acted in a malevolent, uncontrolled or premeditated way to be required to pay punitive damages. Due to this specific set of circumstances, punitive damages are far less common in personal injury cases than compensatory damages.
