Texas Motorcycle Helmet Law Repeal Leads to Rise in Deadly Accidents

In 1997, Texas repealed its mandatory motorcycle helmet law which required all riders to wear a helmet.  The law in Texas since that time only requires motorcyclists under 21 to use a helmet.

A recent study of Texas motorcycle riding, published in the Southern Medical Journal, found that in the seven years after Texas changed its helmet law,
Texas motorcycle accident deaths rose by 25%.  The Texas Department of Transportation contends that deaths have continued to increase since the study concluded.  From 2004 to 2008, Texas motorcycle accident fatalities rose close to 32%.

The Southern Medical Journal study showed a "sudden upward trend" in deadly motorcycle accidents in September 1997, the same month the helmet laws changed.  Following the law's implementation, overall motorcycle deaths increased by 30% and deaths per registered motorcycles increased by 15.2%.

According to TXDOT, motorcycle helmet use decreased from 77% in 1996 to 63% in 1997, then to 36% in 1998 and thereafter.

Texas may need to change its motorcycle helmet law, but this study will likely not have any effect on Texas lawmakers.  One interpretation of the data is that motorcyclists not wearing helmets is adversely affecting Texas highway safety.  Another interpretation is that helmets don't save lives, safe riding does, and the focus on helmets is misplaced.  Some riders claim that the real focus needs to be on increased requirements for training of motorcycle riders in their own safety, and all drivers in how to share the roads with cyclists.

i agree but you also have to look at the rise in numbers of people on the road from 97 to 2010 so dont blame bikers people need to watch what they are doing on the road all of us do and just to make a point if you wreak going over 65 mph you dont have much of a chance any way and i can say that because i am a 38 year old nurse and have seen a lot of people wreak on bikes

Although there are some key points to this article. I do have to disagree with some things. So yeah I can see how all our precentages have increased since we have changed our Helment Laws. One thing you should look at is how many of them accidents were the person riding the motorcycle were at fault?? Not say that all of them weren't. But I bet you would be surprised. Not saying that motorcyclist are never causing accidents, because that would be a lie due to I have seen many fellow riders I wanted to go up and slap for doing reckless things and causing the rest to get a bad Name. Number 1 thing is the motor cycle it self is as safe as anything on the road. They made it that way, but the people driving them and the other drivers are the ones that arent safe. Now days with people driving and talking on the phone or texting or putting on makeup or even reading papers while driving or even driving under the influence is unsafe. I have been on 2 wheels since I was Yet people able to stand i have been on them. Starting with dirt bikes then graduated with Street Legal. I have only been in 1 motor cycle accident in my whole life, and the funny thing is it wasnt even my fault. I had lady in her twentys apperantly paying attention to something else besides the road due to her hitting me while I was stopped and waiting to turn left. I am 24 years old. People might say I might not know alot due to my age but like I said I have been on these machaines since I could stand. SOrry I seemed to ramble on and on.
