  • Speaking out about a Fatal Train-car Collision in North Carolina

by Matthew D. Shaffer on December 29, 2009

The North Carolina Highway Patrol and the Department of Transportation continue to investigate a fatal train-car collision that took the lives of a young mother and her 5-year-old son, Nicholas Lindsay.  The mother drove under the train's crossing arms and her Toyota hit on the tracks by a Norfolk Southern Railroad traincar.  The 5 year-old was found about 100 feet up from the accident scene, lying on the side of the tracks.

The father now visits the only survivor of his young family's crash, a baby, at UNC Hospitals.  His four-month-old daughter Aven was inside the Toyota but survived the collision.  She was pulled from the car by bystanders after the accident.  Updates on the child's condition will be posted at http://www.twitter.com/unc_health_care online.

Troopers said all three occupants of the car were properly restrained.

Norfolk Southern has fielded 11 calls in just this past year regarding problems with the crossing.  Several local residents said the warning lights and caution bar at this railroad crossing malfunctioned routinely.

Amtrak said none of the 215 passengers on the Carolinian were hurt.

North Carolina ranks among the top 15 states for train collisions because of the number of railroad tracks in the state.

To battle the railroad giants you must have an experienced team of FELA lawyers on your side.  If you are serious about your claim you need serious representation.  At Schechter McElwee, Shaffer & Harris, L.L.P., we have over 100 years of experience in personal injury law.  We have handled the toughest Railroad Injury cases from around the country.  If you or a loved one has been involved in an on the job railroad accident, please call (800) 282-2122 today for your free consultation or email us at info@smslegal.com.
