The fathers of a San Antonio couple killed in a bicycle accident filed a wrongful-death lawsuit against the motorist Gilbert John Sullaway Jr., 40, on behalf of the couple's 7-year-old daughter, Kylie.
Kylie's parents were killed in October when Sullaway drove his Ford F-150 King Ranch work truck off Texas 16 and hit them while they were riding their tandem bicycle along the highway. The Bruehlers took their safety seriously, and each wore a helmet on the day they died.
The lawsuit also names Sullaway's business, Advanced Detection Security Services Inc., since he was on duty at the time of the incident.
The wreck deeply disturbed San Antonio's cycling community. No traffic citations or criminal charges have been filed against Sullaway. Tiger Woods hits an inanimate object, a tree, going slowly and he gets a ticket, while the driver in this case kills two people and goes unpunished.
The family cited their primary reason for filing a lawsuit as the financial support of the now orphaned Kylie. However, they did say that if it helps the bicycling community and the fight to ban cell phone use while driving, that would be an added plus.
No matter the outcome of this case, this crash has affected Texas cyclists. As personal injury lawyers, we see injuries such as traumatic brain injury, spinal cord damage, broken bones, and others when dealing with cases involving a bicycle versus a motor vehicle, especially a truck. Please use caution when deciding where to ride your bike and what protective gear to wear while you are on it.
