Family of Dallas Truck Accident Victim Sues Driver

As Texas truck accident attorneys, we often come across accidents in which injuries are caused even in the absence of direct impact between the truck and another vehicle. In 2007, a 57-year-old Dallas man was killed when a truck crashed in to a median, leading to a large piece of concrete smashing though the victim's car windshield. The family of the victim William Bond, has now filed a lawsuit against the trucker in that accident.
Bond was returning home with his brother from a cancer treatment facility. The trucker Christopher Spicer was tail gating another vehicle when he lost control of the truck. The vehicle crashed into a median, and flipped over. A large chunk of concrete from the median flew through the windshield of the car in which Bond was traveling. He received the full impact of the crash, and died instantly.
Spicer was never prosecuted for his role in the accident. He was indicted for criminally negligent homicide, but the district attorney said his office would not prosecute the case because it involved no crime, other than speeding.
The lawsuit filed by the Bond family also names the North Texas Tollway Authority and engineering, construction and maintenance companies involved in building and repair activities on the tollway. The Bond family holds that there were two factors in this accident:

1. The driver's failure to maintain safe speeds and drive safely

2. The failure of the North Texas Tollway Authority and other companies to maintain the tollway properly.
Medians are installed to prevent vehicles from veering into opposite lanes. These are meant to keep motorists safe, not cause them harm. You have to wonder what kind of impact causes a large chunk of concrete to crash through a neighboring car's windshield.
