Railroads, Repetitive Stress and Restitution

Matt Shaffer, the managing partner of Schechter, McElwee, Shaffer & Harris, L.L.P., was recently published in the September edition of Trial Magazine. His featured article highlighted the repetitive stress injuries that railroad workers suffer from. While establishing the connection between railroad negligence and injury is often challenging, the goal of demonstrating that an employer should have maintained a safer work environment is achievable. With the assistance of appropriate experts and a comprehensive investigation into the employer's practices and work setting, Matt has been able to establish the negligence of railroads for repetitive stress injuries, such as tendonitis, trigger finger, carpal tunnel syndrome, hearing loss, and chronic back pain.

Deepwater Horizon Oil Rig Explosion Survivor Speaks Out - Tyrone Benton, SMSH Client Speaks with BBC

Tyrone Benton, an honest, hard-working “ROV tech” for Oceaneering, was simply doing his job as a contractor working on the Deepwater Horizon offshore drilling rig when his underwater equipment noted a leak of hydraulic fluid in the rig’s blowout preventer before the massive explosion of April 20, 2010. His job was to assist with remote operated vehicles in surveying the mobile offshore drilling unit (MODU). He reported his findings to his supervisor and the information presumably went onward up the chain of command. However, as we now know, BP sadly did not act on this information and stop its drilling operations to repair the leak.

Unaware of the impact his statements would have, Mr. Benton chose to speak with the media about his work and findings. This video interview with the BBC created media frenzy.
